Terms of Service

1. Acceptance of Terms

By accessing or using Kapwa.social ("Kapwa," "the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users, including event hosts (registered accounts) and guests (unregistered event attendees).

2. Description of Service

Kapwa.social is an event-based photo sharing platform. Hosts create events and invite guests to contribute photos via a unique URL or QR code. No app download or account creation is required for guests.

3. Accounts and Registration

Event hosts must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it up to date.

Guests do not require an account. However, guests must provide a valid name and contact information (email or phone number) to join an event. False or misleading information may result in removal from the event.

4. Content and Uploads

Your content

You retain ownership of photos and content you upload. By uploading content to Kapwa.social, you grant us a non-exclusive, worldwide license to store, process, display, and distribute your content solely for the purpose of operating the Service — including applying watermarks and displaying photos in the event gallery.

Content standards

You must not upload content that:

• Is illegal, obscene, defamatory, threatening, or harassing
• Depicts nudity or sexually explicit material
• Depicts violence, gore, or graphic harm
• Violates the privacy or intellectual property rights of others
• Depicts minors in any inappropriate context
• Is spam or uploaded in bad faith

We reserve the right to remove any content that violates these standards without notice.

Accountability

Every upload is logged with the uploader's name, contact information, IP address, device fingerprint, and timestamp. This information is retained for legal and safety purposes and may be disclosed to law enforcement upon valid legal request.

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Upload photos of individuals without their consent
• Attempt to circumvent any security or access controls
• Use automated tools to scrape, download, or mass-access content
• Impersonate another person or entity
• Interfere with the proper functioning of the Service
• Provide false contact information during guest check-in

6. SMS Communications

By providing a phone number to join an event or receive an invitation, you consent to receive SMS messages from Kapwa.social on behalf of the event host. Message and data rates may apply.

To opt out of SMS messages, reply STOP to any message. To get help, reply HELP. Message frequency varies by event. For support, contact hello@kapwa.social.

7. Subscriptions and Payments

Kapwa.social offers free and paid tiers. Paid subscriptions are billed monthly or annually via Stripe. All payments are non-refundable except as required by applicable law.

Subscription cancellation takes effect at the end of the current billing period. A 30-day grace period applies after cancellation during which events remain accessible.

We reserve the right to change pricing with 30 days notice to registered hosts.

8. Event Expiry and Data

Event albums expire based on your subscription tier:

• Free tier: 15 days after the event date
• Event Pass: 30 days after the event date
• Subscription: for the duration of your active subscription

After expiry, events are archived and photos become inaccessible until the host upgrades. Archived events are not permanently deleted immediately — data is retained for 90 days post-expiry before purge.

9. Intellectual Property

The Kapwa.social platform, including its design, code, branding, and features, is owned by Kapwa.social and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written permission.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We are not responsible for the content uploaded by hosts or guests. Event hosts are solely responsible for the content and conduct of their events.

11. Limitation of Liability

To the maximum extent permitted by law, Kapwa.social shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the Service.

Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting hello@kapwa.social.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered hosts of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
